Terms & Conditions

Please read these Terms & Conditions carefully before enrolling in any program or using the Smart Driving School online enrollment platform. By creating an account and enrolling, you confirm that you have read, understood, and agreed to these terms.

1. Introduction & Acceptance

These Terms & Conditions (the “Terms”) constitute a binding agreement between you (the “Student,” “you,” or “your”) and Smart Driving School (“Smart Driving School,” the “Company,” “we,” “us,” or “our”). They govern your enrollment in our programs and your use of our website and online enrollment platform (the “Platform”).

By registering an account, enrolling in a program, or otherwise using the Platform, you acknowledge that you are doing so voluntarily and of your own free will, for the purpose of enhancing your driving skills and abilities, and that you fully understand and agree to be bound by these Terms. If you do not agree, please do not register or enroll.

2. Eligibility & Account Registration

  • You must provide true, accurate, and complete information during registration and keep it up to date. Enrollment is personal to you and may not be transferred to another person.
  • Registration requires a valid email address. You must verify your email through the one-time passcode (OTP) we send before your account is activated.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must abide by the separate rules and regulations in force wherever your lessons are conducted, whether on the Platform, in a classroom, at a training center, or in a training vehicle.

3. Programs & Services

Smart Driving School offers driver-education programs including, but not limited to, the Theoretical Driving Course (TDC), the Practical Driving Course (PDC), motorcycle programs, course upgrades, and driving proficiency programs. By enrolling, you confirm that the details of the program have been adequately explained to you and that you are enrolling voluntarily.

You understand and agree to the tuition fees set forth for your chosen program and acknowledge that additional payments may be collected for additional hours or for services outside the scope of your enrollment.

4. Payment Policy

  • Online payments are processed only through our authorized payment gateway, Maya (PayMaya). Payments made at a branch must be made to authorized personnel only. Always secure your official receipt — payments without a corresponding receipt will not be acknowledged for the reservation of classes or examinations.
  • When paying online, you may settle the full amount, a partial amount, or any custom amount of at least thirty percent (30%) of your outstanding balance, as offered at checkout.
  • If you availed of a service through the Platform, the official website, or an authorized online channel, any upgrade to your chosen program shall be processed at the branch where you report for your driving lessons.
  • Present a copy of your enrollment confirmation together with a valid ID at your branch so that your registration can be verified.
  • Your remaining balance must be paid in full before the first hour of driving lessons, and before reserving your desired classes or driving schedules.
  • Complimentary additional hours and other freebies, where offered, apply only to cash payments enrolled in selected programs, unless other arrangements are made in writing.
  • Fees are subject to change without prior notice.

5. Refunds, Cancellations & Course Downgrading

  • For enrollment cancellation or course downgrading, the Company reserves the right to deny a refund of any fees or payments made, in order to compensate for the time and resources spent on preparations, purchases, and other expenses directly or indirectly related to the enrollment.
  • Where a cancellation refund or course-downgrade refund is approved, a charge of thirty percent (30%) of the total tuition fee shall be deducted to cover incurred operational and reservation expenses.
  • The Company has the right to disapprove a request for refund or downgrade at its reasonable discretion.

6. Scheduling & Cancellation of Lessons

  • Upon successful enrollment, you are required to coordinate your classroom and driving schedules with an authorized sales representative or with your nearest branch.
  • Schedules are subject to the terms of your enrolled program, the initial payments made, and the availability of facilities, training vehicles, and instructors.
  • Cancellation of a driving or classroom schedule must be made at least two (2) working days, during office hours, before the arranged schedule. Holidays and Sundays are not counted.
  • A cancellation made less than two (2) working days before the schedule is not permitted, and the affected schedule shall be considered forfeited.
  • Absences due to medical reasons are subject to approval upon review of a medical certificate and a personal letter from the student requesting non-forfeiture of the schedule.
  • The Company reserves the right to cancel, stop, or postpone lessons at any time and in any situation that may place the student, instructor, or training vehicle at risk.

7. Additional Regulations for Motorcycle Students

  • By enrolling in the Motorcycle PDC, you truthfully declare that you know how to ride a motorcycle, that you are not pregnant (for female students), and that you are physically and mentally fit to operate a motorcycle. Failure to meet these qualifications may result in forfeiture of enrollment.
  • Safety gear may be provided, but students are required to wear proper attire (long sleeves or a jacket, long pants, and closed shoes, preferably without laces). Students may bring their own gear for added hygiene.
  • Be punctual for your scheduled time. As classes are conducted in batches, late arrivals may result in forfeiture of the reserved slot.

8. Student Conduct & Requirements

  • Always bring all Smart Driving School official receipts, your assessment form, and the physical copy of your student's permit or license whenever you have driving lessons. Under our No Documents – No Driving Lessons policy, digital copies, photographs, and photocopies are not accepted.
  • Video recording during lessons and examinations is not allowed.
  • Chaperones are not allowed during seminars, examinations, certificate encoding, or driving lessons.
  • Students who are visibly under the influence of alcohol or prohibited drugs will not be allowed to drive, and the affected lesson shall be forfeited.
  • Please wear smart-casual attire during lessons and examinations. Shorts, sleeveless tops, and slippers or sandals are not allowed.
  • For security reasons, do not bring firearms or deadly weapons. Do not bring valuable belongings or jewelry while driving. The Company shall not be liable for any loss of personal property.

9. Certificates & LTO Processing

Processing of certificates takes three (3) to five (5) working days. This period may be extended if there are concerns with your LTO personal account or if the LTO experiences technical difficulties (such as system downtime or logging issues). Please coordinate with your sales representative for follow-up. Additional charges may apply where certification is required or specifically requested.

10. Enrollment Validity

Enrollment is non-transferable and remains valid for ninety (90) days from the date of registration, or until driving schedules have been plotted with us, whichever applies.

11. Limitation of Liability

To the fullest extent permitted by law, Smart Driving School shall not be liable for any loss, injury, or damage arising from a student's failure to follow these Terms, the instructions of an instructor, or applicable traffic and safety laws, nor for the loss of personal belongings brought to lessons, examinations, or training centers.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising from these Terms or your enrollment shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or in applicable law. The “Last updated” date above indicates when these Terms were last revised. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
